Are you Allowed to Get Married While on a Travel Visa?
Many people have heard rumors about immigrants with visas trying to marry an American citizen in order to stay in the country. Even if they're married though, many foreign people are sent back to their own country even if they're married when their visa expires. Permanent residency isn't a guarantee if you marry someone while on a travel visa.
Most American citizens feel this is a touchy subject due to the recession, rising costs of essential goods, and many other reasons. Not many people have a problem with legal immigrants, however, they certainly have a problem with people who try to avoid the laws.
However, it is possible to marry while on a travel visa and be given citizenship status, but this isn't very common. American citizens who try to marry a foreigner may be surprised how things work out for them as well. You will likely need to hire an immigration attorney, a very expensive proposal. In order to prove the validity of the marriage, you have to prove that the marriage while on a travel visa wasn't planned ahead of time. This can easily happen if a student is studying in the country and meets someone who they end up marrying. This situation will likely be quite easy to prove that they didn't come to the U.S. with the intentions of marrying someone.
Even with this type of situation though, it's not guaranteed to work out the way that you hope. A change of legal status will be based on many other things, such as health status, a criminal background, or just the fact that intent when entering the country can't be proven. The person can easily be sent back to their own country and be unable to enter into the country ever again. If this would happen to you, the American spouse could then be faced with either packing up his or her life and moving to the spouse's country or living and raising any children on a single basis here.
